Narrative:
Cleared for approach runway 9L at kfll. On centerline and GS, passing 3600 MSL approach issued TA 1 O'clock 3000 MSL. Visually sighted a small small aircraft aircraft heading 060 degrees. TCASII issued a TA then an RA commanding 2000 FPM rate of climb. Closest point of approach was 400 ft vertical 0 ft lateral. At no time did the small aircraft aircraft make any maneuvers. Arsa in this area is 4000 ft/10 mi. Small aircraft aircraft was not in radio contact with the approach facility, but did have his mode 'C' turned on. 100% probability of midair except for 'heads up' from approach, TCASII, and evasive action taken!

SMA ACFT WAS NOT IN RADIO CONTACT WITH THE APCH FACILITY, BUT DID HAVE HIS MODE 'C' TURNED ON. 100% PROBABILITY OF MIDAIR EXCEPT FOR 'HEADS UP' FROM APCH, TCASII, AND EVASIVE ACTION TAKEN!
