Narrative:
After contacting departure control passing through 2000 ft we were given a right turn direct rmg and a climb to 10000 ft. We received a TCASII advisory at 3200 ft MSL. The aircraft was at 2 O'clock and closing. Passing 3500 ft we received a TCASII warning and a command to descend. We followed the TCASII commands and leveled at 3500 ft. We saw the aircraft visually at this point passing approximately 1/2 mi to our right and 500 ft above us. No traffic was called by departure control. I don't believe the controller had him on radar or was talking to him. Also, numerous small aircraft in the area and excessive chatter on the radio may have distracted the controller.

Title: MLG ON INITIAL CLB HAS TCASII RA TO DSND. COMPLIES THEN SIGHTS ACFT PASSING ABOVE.
Narrative: AFTER CONTACTING DEP CTL PASSING THROUGH 2000 FT WE WERE GIVEN A R TURN DIRECT RMG AND A CLB TO 10000 FT. WE RECEIVED A TCASII ADVISORY AT 3200 FT MSL. THE ACFT WAS AT 2 O'CLOCK AND CLOSING. PASSING 3500 FT WE RECEIVED A TCASII WARNING AND A COMMAND TO DSND. WE FOLLOWED THE TCASII COMMANDS AND LEVELED AT 3500 FT. WE SAW THE ACFT VISUALLY AT THIS POINT PASSING APPROX 1/2 MI TO OUR R AND 500 FT ABOVE US. NO TFC WAS CALLED BY DEP CTL. I DON'T BELIEVE THE CTLR HAD HIM ON RADAR OR WAS TALKING TO HIM. ALSO, NUMEROUS SMALL ACFT IN THE AREA AND EXCESSIVE CHATTER ON THE RADIO MAY HAVE DISTRACTED THE CTLR.
