Narrative:

I took off from hya airport in ma, VFR under part 91, call sign nx en route to bar harbor, me. While climbing up to FL240, I leveled off at 18000 ft , called bos center on 128.20 and gave the control my bearing, distance from airport that I just took off from the problem that I might have is, I was at the very base of the positive control area asking for an IFR clearance to FL240 en route to bar harbor, me. In giving my position distance and altitude, I stated I was at 18000 ft, when actually I should have had a clear at 17999, under FAA rules no one is supposed to be in a positive control area 18000- 60000 without an IFR clear.

Title: AN LTT PENETRATED POSITIVE CTL AIRSPACE, WITHOUT CLRNC ON A NIGHT FERRY FLT.

Narrative: I TOOK OFF FROM HYA ARPT IN MA, VFR UNDER PART 91, CALL SIGN NX ENRTE TO BAR HARBOR, ME. WHILE CLBING UP TO FL240, I LEVELED OFF AT 18000 FT , CALLED BOS CTR ON 128.20 AND GAVE THE CTL MY BEARING, DISTANCE FROM ARPT THAT I JUST TOOK OFF FROM THE PROBLEM THAT I MIGHT HAVE IS, I WAS AT THE VERY BASE OF THE POSITIVE CTL AREA ASKING FOR AN IFR CLRNC TO FL240 ENRTE TO BAR HARBOR, ME. IN GIVING MY POS DISTANCE AND ALT, I STATED I WAS AT 18000 FT, WHEN ACTUALLY I SHOULD HAVE HAD A CLR AT 17999, UNDER FAA RULES NO ONE IS SUPPOSED TO BE IN A PCA 18000- 60000 WITHOUT AN IFR CLR.
