Narrative:
While cruising at our assigned altitude of FL270, TCASII advised us of traffic at our 1230 O'clock position approximately 15-18 NM ahead of us, 1700 ft below us and climbing. As traffic approached, it continued climbing and when traffic passed 1000 ft below us, an 'RA' was issued by the TCASII. It told us to climb at a min rate of 1000 FPM. As we started to follow the RA, we advised ATC of the situation and his response was, 'don't do anything -- traffic is at 260.' we exceeded our assigned altitude of FL270 by approximately 400 ft and the traffic came no closer than 800 ft vertical according to TCASII. We returned to our assigned altitude and advised center that we were back on altitude. TCASII worked as described and all commands were followed.
Original NASA ASRS Text
Title: AN ACR MLG IN IMC CLBED IN RESPONSE TO ANOTHER ACFT THAT WAS CLBING TOWARDS THE RPTING ACFT.
Narrative: WHILE CRUISING AT OUR ASSIGNED ALT OF FL270, TCASII ADVISED US OF TFC AT OUR 1230 O'CLOCK POS APPROX 15-18 NM AHEAD OF US, 1700 FT BELOW US AND CLBING. AS TFC APCHED, IT CONTINUED CLBING AND WHEN TFC PASSED 1000 FT BELOW US, AN 'RA' WAS ISSUED BY THE TCASII. IT TOLD US TO CLB AT A MIN RATE OF 1000 FPM. AS WE STARTED TO FOLLOW THE RA, WE ADVISED ATC OF THE SITUATION AND HIS RESPONSE WAS, 'DON'T DO ANYTHING -- TFC IS AT 260.' WE EXCEEDED OUR ASSIGNED ALT OF FL270 BY APPROX 400 FT AND THE TFC CAME NO CLOSER THAN 800 FT VERT ACCORDING TO TCASII. WE RETURNED TO OUR ASSIGNED ALT AND ADVISED CTR THAT WE WERE BACK ON ALT. TCASII WORKED AS DESCRIBED AND ALL COMMANDS WERE FOLLOWED.
