Narrative:

During routine departures off dtw, air carrier X refused a climb clearance because his TCASII showed he was catching air carrier Y 12-15 mi in front, same direction, but on diverging courses. ATC computer showed aircraft were same speed. This is improper use of TCASII. TCASII should be used to avoid imminent sits, not second-guess controller actions. Even if a potential situation existed 12 mi intrail would require a hugh over-take in order for TCASII to become a factor in air safety.

Title: ACR X NON ADHERENCE TO ATC CLRNC REFUSED CLB CLRNC MISUSE OF TCASII. PLTDEV.

Narrative: DURING ROUTINE DEPS OFF DTW, ACR X REFUSED A CLB CLRNC BECAUSE HIS TCASII SHOWED HE WAS CATCHING ACR Y 12-15 MI IN FRONT, SAME DIRECTION, BUT ON DIVERGING COURSES. ATC COMPUTER SHOWED ACFT WERE SAME SPD. THIS IS IMPROPER USE OF TCASII. TCASII SHOULD BE USED TO AVOID IMMINENT SITS, NOT SECOND-GUESS CTLR ACTIONS. EVEN IF A POTENTIAL SIT EXISTED 12 MI INTRAIL WOULD REQUIRE A HUGH OVER-TAKE IN ORDER FOR TCASII TO BECOME A FACTOR IN AIR SAFETY.
