Narrative:

After completing 3 days of flying at AI30 I was assigned to report at JF00 the following day. I was assigned 6 legs to finish at AI15. Please note that even though I received legal rest the night prior, 10 hours 45 mins, I actually rested 6 hours, taking into consideration the travel time from work to home. During the return trip, leg #2, the first officer and I were having trouble staying alert while flying into ord. After we performed the before landing checks we forgot to select the gear down and had to be reminded by the 'too low gear' warning. After parking the aircraft, my first officer and I discussed what happened and were both convinced we would have landed gear up without the warning. With 4 legs to complete, I called crew scheduling in dfw to indicate I was fatigued, and have another captain fly legs 3 and 4 so I could sleep for 2 1/2 hours. Crew scheduling allowed the request and made it clear that I had to fly legs 5 and 6. Later, I learned such a request resulted in a reduction of pay of 1 full day. Crew scheduling indicated that, even though I was on duty for 14 1/2 hours and flew 4 1/2 hours, they considered the request an emergency leave of absence. Actions such as this promote problems concerning safety. Working for a regional with schedules that are as fatigue-inducing as they are, leaves no room for the abuse imposed by company management. This incident clearly states the importance for clarification and modification pertaining to legal rest requirements. Note: at present, I am investigating whether I violated the FARS concerning legal rest. If I was on a leave of absence during legs 3 and 4, then I must have been released from duty. If so, I did not receive legal rest before completing legs 5 and 6.

Title: COMMUTER PLT REQUESTS RELIEF PLT DUE TO FATIGUE.

Narrative: AFTER COMPLETING 3 DAYS OF FLYING AT AI30 I WAS ASSIGNED TO RPT AT JF00 THE FOLLOWING DAY. I WAS ASSIGNED 6 LEGS TO FINISH AT AI15. PLEASE NOTE THAT EVEN THOUGH I RECEIVED LEGAL REST THE NIGHT PRIOR, 10 HRS 45 MINS, I ACTUALLY RESTED 6 HRS, TAKING INTO CONSIDERATION THE TRAVEL TIME FROM WORK TO HOME. CREW SCHEDULING ALLOWED THE REQUEST AND MADE IT CLR THAT I HAD TO FLY LEGS 5 AND 6. LATER, I LEARNED SUCH A REQUEST RESULTED IN A REDUCTION OF PAY OF 1 FULL DAY. CREW SCHEDULING INDICATED THAT, EVEN THOUGH I WAS ON DUTY FOR 14 1/2 HRS AND FLEW 4 1/2 HRS, THEY CONSIDERED THE REQUEST AN EMER LEAVE OF ABSENCE. ACTIONS SUCH AS THIS PROMOTE PROBS CONCERNING SAFETY. WORKING FOR A REGIONAL WITH SCHEDULES THAT ARE AS FATIGUE-INDUCING AS THEY ARE, LEAVES NO ROOM FOR THE ABUSE IMPOSED BY COMPANY MGMNT. THIS INCIDENT CLRLY STATES THE IMPORTANCE FOR CLARIFICATION AND MODIFICATION PERTAINING TO LEGAL REST REQUIREMENTS. NOTE: AT PRESENT, I AM INVESTIGATING WHETHER I VIOLATED THE FARS CONCERNING LEGAL REST. IF I WAS ON A LEAVE OF ABSENCE DURING LEGS 3 AND 4, THEN I MUST HAVE BEEN RELEASED FROM DUTY. IF SO, I DID NOT RECEIVE LEGAL REST BEFORE COMPLETING LEGS 5 AND 6.
