Narrative:
Takeoff out of miami, unable to retract slat #7. Returned for landing after completing abnormal checklist. We determined our landing would be at maximum landing weight plus or minus a few hundred pounds. We wound up landing 800 pounds over maximum landing weight. Our operations manual states to declare an emergency due to overweight landing. We didn't declare an emergency because we felt our weight would be within limits. We made a normal landing. We felt that the short approach that miami gave us contributed to the overweight landing. We thought that we were going to be safe landing whether we were a few hundred pounds over or under maximum landing weight.

Title: AN ACR LGT HAD A PARTIAL SLAT FAILURE. IT LANDED OVERWT WITHOUT DECLARING AN EMER, AGAINST COMPANY PROC.
Narrative: TKOF OUT OF MIAMI, UNABLE TO RETRACT SLAT #7. RETURNED FOR LNDG AFTER COMPLETING ABNORMAL CHKLIST. WE DETERMINED OUR LNDG WOULD BE AT MAX LNDG WT PLUS OR MINUS A FEW HUNDRED LBS. WE WOUND UP LNDG 800 LBS OVER MAX LNDG WT. OUR OPS MANUAL STATES TO DECLARE AN EMER DUE TO OVERWT LNDG. WE DIDN'T DECLARE AN EMER BECAUSE WE FELT OUR WT WOULD BE WITHIN LIMITS. WE MADE A NORMAL LNDG.
