Narrative:
While cruising at FL310 in houston's airspace we received a TCASII RA with no previous TA or ATC advisory of aircraft at our altitude. After the RA occurred we climbed in accordance with the TCASII command to 'climb climb now.' in the climb we told ZHU what we were doing and why. He informed us he saw no aircraft on his radar, but there was an aircraft above us at FL330. Our TCASII maneuver resulted in less than 2000 ft vertical separation with the aircraft above and 600-700 ft vertical separation as shown by the TCASII with the aircraft below. When the RA was over 'clear of conflict' we pushed flight level change on the autoplt control panel to return to FL310. The autoplt took us fast about 300 ft below FL310 before we recovered the aircraft back to FL310.

Title: FLC OF AN MLG ACR ACFT CLBED ABOVE ASSIGNED HIGH CRUISING ALT IN RESPONSE TO A TCASII RA RESULTING IN LESS THAN LEGAL SEPARATION WITH ANOTHER ACFT ABOVE.
Narrative: WHILE CRUISING AT FL310 IN HOUSTON'S AIRSPACE WE RECEIVED A TCASII RA WITH NO PREVIOUS TA OR ATC ADVISORY OF ACFT AT OUR ALT. AFTER THE RA OCCURRED WE CLBED IN ACCORDANCE WITH THE TCASII COMMAND TO 'CLB CLB NOW.' IN THE CLB WE TOLD ZHU WHAT WE WERE DOING AND WHY. HE INFORMED US HE SAW NO ACFT ON HIS RADAR, BUT THERE WAS AN ACFT ABOVE US AT FL330. OUR TCASII MANEUVER RESULTED IN LESS THAN 2000 FT VERT SEPARATION WITH THE ACFT ABOVE AND 600-700 FT VERT SEPARATION AS SHOWN BY THE TCASII WITH THE ACFT BELOW. WHEN THE RA WAS OVER 'CLR OF CONFLICT' WE PUSHED FLT LEVEL CHANGE ON THE AUTOPLT CTL PANEL TO RETURN TO FL310. THE AUTOPLT TOOK US FAST ABOUT 300 FT BELOW FL310 BEFORE WE RECOVERED THE ACFT BACK TO FL310.
