Narrative:

On departure out of roc, we were being vectored by departure control out of the area to our first en route fix. We had departed runway 4 at roc and were in a left turn to a 180 degree heading until receiving gee VOR then direct and simultaneously climbing to an assigned altitude of 10000 ft MSL. Just prior to completion of the turn and while leveling at 10000 ft MSL, our TCASII issued a TA for traffic about 100 ft below our assigned altitude and approximately 11 O'clock position and less than 3 mi. Shortly thereafter, we received an RA to climb so as to avoid the traffic. Climbed above our assigned altitude of 10000 ft as per the RA while visual contact was made. It seemed that the controller lost his mental radar picture.

Title: ACR X TCASII TA RA POSSIBLE LTSS FROM Y EVASIVE ACTION TAKEN.

Narrative: ON DEP OUT OF ROC, WE WERE BEING VECTORED BY DEP CTL OUT OF THE AREA TO OUR FIRST ENRTE FIX. WE HAD DEPARTED RWY 4 AT ROC AND WERE IN A L TURN TO A 180 DEG HDG UNTIL RECEIVING GEE VOR THEN DIRECT AND SIMULTANEOUSLY CLBING TO AN ASSIGNED ALT OF 10000 FT MSL. JUST PRIOR TO COMPLETION OF THE TURN AND WHILE LEVELING AT 10000 FT MSL, OUR TCASII ISSUED A TA FOR TFC ABOUT 100 FT BELOW OUR ASSIGNED ALT AND APPROX 11 O'CLOCK POS AND LESS THAN 3 MI. SHORTLY THEREAFTER, WE RECEIVED AN RA TO CLB SO AS TO AVOID THE TFC. CLBED ABOVE OUR ASSIGNED ALT OF 10000 FT AS PER THE RA WHILE VISUAL CONTACT WAS MADE. IT SEEMED THAT THE CTLR LOST HIS MENTAL RADAR PICTURE.
