Narrative:

ATC called traffic climbing to 8000 ft. Acquired visually and on TCASII with a 'traffic' TA. Traffic climbed through 8000. At 8900 we got a TCASII RA 'descend.' we descended to 8500 while traffic continued to climb. Simultaneously approach gave us a left turn and stated they thought traffic was supposed to level at 8000. We turned and climbed back to 9000 ft and landed uneventfully. Love that TCASII. Supplemental information from acn 256692: on departure from clt controller gave me a climb from 8000 ft to 12000 ft. This change of altitude climbed me through opposite direction traffic at 9000 ft. When I informed controller of conflict he said I was only cleared to 8000 ft. After listening to tapes, controller supervisor informed me I was correct and the controller was in error.

SUPPLEMENTAL INFO FROM ACN 256692: ON DEP FROM CLT CTLR GAVE ME A CLB FROM 8000 FT TO 12000 FT. THIS CHANGE OF ALT CLBED ME THROUGH OPPOSITE DIRECTION TFC AT 9000 FT. WHEN I INFORMED CTLR OF CONFLICT HE SAID I WAS ONLY CLRED TO 8000 FT. AFTER LISTENING TO TAPES, CTLR SUPVR INFORMED ME I WAS CORRECT AND THE CTLR WAS IN ERROR.
