Narrative:

Cruising eastbound FL330 on UA33 approaching brd. Target suddenly appeared on TCASII at 10 NM, 1000 ft below and climbing, slightly to right, opposite direction. TA followed immediately by RA commanding climb. Initiated left climbing turn but target continued to climb with us until target appeared to merge. TCASII finally announced clear of traffic at just over 34000 ft. Returned to altitude (FL330) and continued on course UA14 south of brd. Subsequent conversation revealed target to be cleared to climb to FL390. Both aircraft under positive radar control with brindise radar. We did not see the aircraft, but they saw us and estimated the miss at 200- 300 ft. Brindise controller admitted mistake and both aircraft advised would be filing near miss report.

Narrative: CRUISING EBOUND FL330 ON UA33 APCHING BRD. TARGET SUDDENLY APPEARED ON TCASII AT 10 NM, 1000 FT BELOW AND CLBING, SLIGHTLY TO R, OPPOSITE DIRECTION. TA FOLLOWED IMMEDIATELY BY RA COMMANDING CLB. INITIATED L CLBING TURN BUT TARGET CONTINUED TO CLB WITH US UNTIL TARGET APPEARED TO MERGE. TCASII FINALLY ANNOUNCED CLR OF TFC AT JUST OVER 34000 FT. RETURNED TO ALT (FL330) AND CONTINUED ON COURSE UA14 S OF BRD. SUBSEQUENT CONVERSATION REVEALED TARGET TO BE CLRED TO CLB TO FL390. BOTH ACFT UNDER POSITIVE RADAR CTL WITH BRINDISE RADAR. WE DID NOT SEE THE ACFT, BUT THEY SAW US AND ESTIMATED THE MISS AT 200- 300 FT. BRINDISE CTLR ADMITTED MISTAKE AND BOTH ACFT ADVISED WOULD BE FILING NEAR MISS RPT.
