Narrative:
In level flight at FL280, received TCASII RA for intruding aircraft. TCASII commanded a climb. I left my assigned altitude and followed the TCASII RA for 400 ft climb to FL284. Conflict was caused by an aircraft climbing below me to FL270. His high rate of climb created the RA. The TCASII system has no way of knowing that the intruder aircraft is assigned FL270 or is planning on a leveloff. This type of conflict (TCASII conflict) is not uncommon. After climbing out of my assigned altitude I advised ATC and returned to FL280 after the RA was resolved. ATC should avoid, if possible. Climbing 1 aircraft directly into the flight path of another with only 1000 ft clearance.

Title: TCASII PARAMETERS TRIGGERED BY HIGH CLB RATE OF INTRUDING ACFT. EVASIVE ACTION INITIATED. NO NMAC.
Narrative: IN LEVEL FLT AT FL280, RECEIVED TCASII RA FOR INTRUDING ACFT. TCASII COMMANDED A CLB. I LEFT MY ASSIGNED ALT AND FOLLOWED THE TCASII RA FOR 400 FT CLB TO FL284. CONFLICT WAS CAUSED BY AN ACFT CLBING BELOW ME TO FL270. HIS HIGH RATE OF CLB CREATED THE RA. THE TCASII SYS HAS NO WAY OF KNOWING THAT THE INTRUDER ACFT IS ASSIGNED FL270 OR IS PLANNING ON A LEVELOFF. THIS TYPE OF CONFLICT (TCASII CONFLICT) IS NOT UNCOMMON. AFTER CLBING OUT OF MY ASSIGNED ALT I ADVISED ATC AND RETURNED TO FL280 AFTER THE RA WAS RESOLVED. ATC SHOULD AVOID, IF POSSIBLE. CLBING 1 ACFT DIRECTLY INTO THE FLT PATH OF ANOTHER WITH ONLY 1000 FT CLRNC.
