Narrative:

Air carrier flight en route from roc to pit, climbing to 10000 ft. ATC in contact with commuter flight. Commuter acknowledged, said he had us in sight. I saw target on TCASII, decided to stop climb since he was in close proximity. After leveloff I got an RA to climb. At same time I had visual contact with intruder aircraft. Then I got an RA to 'descend.' I followed TCASII RA and missed aircraft as a result of my maneuver to avoid. Roc departure controller didn't consider this event a safety issue since other intruding aircraft had us in sight, even though I had to maneuver to miss him.

Title: AN ACR FLC RESPONDED TO A TCASII RA IN ORDER TO AVOID A COMMUTER ACFT.

Narrative: ACR FLT ENRTE FROM ROC TO PIT, CLBING TO 10000 FT. ATC IN CONTACT WITH COMMUTER FLT. COMMUTER ACKNOWLEDGED, SAID HE HAD US IN SIGHT. I SAW TARGET ON TCASII, DECIDED TO STOP CLB SINCE HE WAS IN CLOSE PROX. AFTER LEVELOFF I GOT AN RA TO CLB. AT SAME TIME I HAD VISUAL CONTACT WITH INTRUDER ACFT. THEN I GOT AN RA TO 'DSND.' I FOLLOWED TCASII RA AND MISSED ACFT AS A RESULT OF MY MANEUVER TO AVOID. ROC DEP CTLR DIDN'T CONSIDER THIS EVENT A SAFETY ISSUE SINCE OTHER INTRUDING ACFT HAD US IN SIGHT, EVEN THOUGH I HAD TO MANEUVER TO MISS HIM.
