Air Traffic Incident | Pilot Deviation |
Narrative:
In sum: approximately 150 NM east southeast of ocs, in ZDV airspace (133.17), we approached embedded thunderstorm. Captain requested deviation to the right. ZDV did not respond after 2 or 3 attempts to contact. At 20 mi range from thunderstorm, captain instructed me to turn right. Deviation was minor, about 35 degrees for 1 1/2 mins. ZDV was informed, but still did not respond. As we turned back to PDT per original clearance, ZDV was again informed, this time responding with disapproval of our deviation without center's consent. Captain stated that he exercised his emergency authority/authorized to effect the deviation. Supplemental information from acn 303657: icing and moderate turbulence was encountered. I informed the controller as we made our turn back toward the PDT VORTAC. The controller then started to make a big deal of the fact that I deviated without her consent. A few subsequent radio xmissions ensued between the controller and myself. Will be on tape would the controller care to continue to make a big deal of this matter. The TCASII was monitored throughout, no encounters were present. However, the controller did make mention of military aircraft climbing to FL310.
Original NASA ASRS Text
Title: HDG TRACK DEV AROUND TSTM ACTIVITY. RPTR COMPLAINT OF LACK OF ARTCC RADAR CTLR COORD COM DURING EVENT.
Narrative: IN SUM: APPROX 150 NM E SE OF OCS, IN ZDV AIRSPACE (133.17), WE APCHED EMBEDDED TSTM. CAPT REQUESTED DEV TO THE R. ZDV DID NOT RESPOND AFTER 2 OR 3 ATTEMPTS TO CONTACT. AT 20 MI RANGE FROM TSTM, CAPT INSTRUCTED ME TO TURN R. DEV WAS MINOR, ABOUT 35 DEGS FOR 1 1/2 MINS. ZDV WAS INFORMED, BUT STILL DID NOT RESPOND. AS WE TURNED BACK TO PDT PER ORIGINAL CLRNC, ZDV WAS AGAIN INFORMED, THIS TIME RESPONDING WITH DISAPPROVAL OF OUR DEV WITHOUT CTR'S CONSENT. CAPT STATED THAT HE EXERCISED HIS EMER AUTH TO EFFECT THE DEV. SUPPLEMENTAL INFO FROM ACN 303657: ICING AND MODERATE TURB WAS ENCOUNTERED. I INFORMED THE CTLR AS WE MADE OUR TURN BACK TOWARD THE PDT VORTAC. THE CTLR THEN STARTED TO MAKE A BIG DEAL OF THE FACT THAT I DEVIATED WITHOUT HER CONSENT. A FEW SUBSEQUENT RADIO XMISSIONS ENSUED BTWN THE CTLR AND MYSELF. WILL BE ON TAPE WOULD THE CTLR CARE TO CONTINUE TO MAKE A BIG DEAL OF THIS MATTER. THE TCASII WAS MONITORED THROUGHOUT, NO ENCOUNTERS WERE PRESENT. HOWEVER, THE CTLR DID MAKE MENTION OF MIL ACFT CLBING TO FL310.
