Narrative:
With the oct/xx/94 implementation of sfar-71 in hawaii, collision avoidance among tour aircraft has become an increasing concern and reality. Based on the restrs imposed by sfar-71, aircraft are forced into conflict by defining the altitude limits under which tour aircraft can maneuver. No consideration was given to the dissimilar terrain and WX of each hawaiian island. As a result, a 'blanket' regulation has created an environment which jeopardizes air safety. This near midair collision occurred in uncontrolled airspace over the napali coast of kauai. I was crossing the southern most napali valley, nualolo heading 300 degrees at 3500 ft MSL. I called on CTAF (122.7) my position and altitude and intent to descend over nualolo kai. As I looked to my left, an AS350-B descended from above, front left and within 200 ft horizontally and vertically across my nose heading approximately 010 degrees. Although I turned further left and descended to insure aircraft clearance, the reality is that the second aircraft would have collided with me without me having seen nor heard him coming. The second aircraft did not communicate his position nor altitude and in fact was in my blind spot in a near collision attitude. In over 3000 hours of flying tours in hawaii, I have never experienced the problems currently being faced by all pilots since implementation of sfar-71.

Title: NMAC BTWN 2 ROTARY WINGED TFC ACFT.
Narrative: WITH THE OCT/XX/94 IMPLEMENTATION OF SFAR-71 IN HAWAII, COLLISION AVOIDANCE AMONG TOUR ACFT HAS BECOME AN INCREASING CONCERN AND REALITY. BASED ON THE RESTRS IMPOSED BY SFAR-71, ACFT ARE FORCED INTO CONFLICT BY DEFINING THE ALT LIMITS UNDER WHICH TOUR ACFT CAN MANEUVER. THE SECOND ACFT DID NOT COMMUNICATE HIS POS NOR ALT AND IN FACT WAS IN MY BLIND SPOT IN A NEAR COLLISION ATTITUDE. IN OVER 3000 HRS OF FLYING TOURS IN HAWAII, I HAVE NEVER EXPERIENCED THE PROBS CURRENTLY BEING FACED BY ALL PLTS SINCE IMPLEMENTATION OF SFAR-71.
