Narrative:
On oct/mon/95 we were scheduled to fly flight from pdx to sfo. Due to WX induced flow control we were issued a ground delay of 1 1/2 hours. Air carrier dispatch elected to re-route us to sjc in the hopes of arrival in the bay area with improved WX and a chance to 'duck' into sfo. Upon receiving descent clearance we asked ZOA if sfo WX had improved and if so we'd like to change our destination to sfo. The WX was now 1000 ft overcast and 4 mi visual (not a lot of improvement) and we were given clearance to sfo. We landed at sfo without any further questions from ATC about our change of destination. We are now questioning the legality of this obvious circumvention of the intent of the flow control program.

Title: AIRLINE DISPATCH CIRCUMVENTS ATC FLOW CTL WX DELAY BY DISPATCHING FLT TO ANOTHER NEARBY DEST IN HOPES THAT THE FLT WILL BE ABLE TO LAND AT ORIGINAL SCHEDULED DEST UPON ARR IN THE DEST AREA.

ACR DISPATCH ELECTED TO RE-RTE US TO SJC IN THE HOPES OF ARR IN THE BAY AREA WITH IMPROVED WX AND A CHANCE TO 'DUCK' INTO SFO. UPON RECEIVING DSCNT CLRNC WE ASKED ZOA IF SFO WX HAD IMPROVED AND IF SO WE'D LIKE TO CHANGE OUR DEST TO SFO. THE WX WAS NOW 1000 FT OVCST AND 4 MI VISUAL (NOT A LOT OF IMPROVEMENT) AND WE WERE GIVEN CLRNC TO SFO. WE LANDED AT SFO WITHOUT ANY FURTHER QUESTIONS FROM ATC ABOUT OUR CHANGE OF DEST. WE ARE NOW QUESTIONING THE LEGALITY OF THIS OBVIOUS CIRCUMVENTION OF THE INTENT OF THE FLOW CTL PROGRAM.
