Narrative:
On nov/xx/96 I was flying a commander on an IFR flight plan from avl-odf-mpe, at XA55 hours. About 30 DME northeast of odf VOR I requested the ATC on 121.35, for 16000 ft and direct mpe. I was in cruise flight at 14000 ft. This was ZTL frequency. My deviation request was due to rising cloud formations with turbulence and icing in mountainous region. The climb out from avl was in moderate turbulence and rime icing. At 14000 ft we were above the clouds in smooth air and VFR, with 20+ mi visibility. I transmitted 3 times for this request of 16000 ft and direct mpe, to no avail. ATC did not respond. Because I was nearing the hazardous WX directly ahead and not desiring to penetrate, I made 1 last transmission on 121.35, 'commander XXXX deviating direct mpe at 14000 ft.' this heading and altitude gave me clearance from the WX in the odf/VOR vicinity. The ATC was conversing with airliners and not me. At approximately XB10 hours, ATC called me and asked my heading. I told him direct mpe at 14000 ft. A discussion ensued, which alerted me to the ATC lack of knowledge and concentration of my aircraft in the radar environment. After this rambling, he gave me my initial request of direct mpe at 14000 ft. This entire flight, except for the avl climb out, was in VFR conditions. The particular circumstances involving my aircraft and ZTL, may have culminated from previous grievances sent to the FAA administrator in may/90 and jan/94 for the airline mentality and total disregard for GA aircraft (file copies available upon request) against ZTL. The ATC was intentionally disregarding my xmissions, or for some unknown reason, didn't hear them. My actions were under far 91.3(B) to avoid WX conditions and 91.185(B) possible radio failure, remain VFR. I remained on the assigned radar transponder code to alert ATC of my intentions.
