Narrative:
At about XA35 a B767 flight at FL390 was issued a turn for traffic, no reply. Another turn immediately, no reply. Last traffic alert turn, no reply. A340 flight was turned, no reply. However, this flight did take the TA turn. The B767 then says he is taking the TCASII alert evasive climb to FL394, however never turned. B767 added he never received any turns, while another flight (air carrier) volunteered that he had copied all the xmissions.

Title: ARTCC RADAR CTLR ISSUED TURN TO A B767 FOR TFC, GOT NO RESPONSE AND TRIED 2 MORE TIMES TO TURN ACFT. THE CONFLICTING TFC, AN A340, HEARD THE CTLR GIVE THE TA TURN AND DID TURN. SUBSEQUENTLY THE B767 GOT A TCASII RA AND FOLLOWED IT, AND THEN TOLD ATC HE HAD NEVER HEARD THE TURNS GIVEN TO HIM. ANOTHER ACR ON THE FREQ HEARD ALL THE CTLR'S XMISSIONS.
