Narrative:
Climbed south departure off mmu to 6000 ft and vectored the G3 towards cov VOR. Radar idented the MD80 southwest of ewr and turned aircraft northbound and climbed aircraft to 5000 ft. When aircraft were 8 mi apart, I called traffic for both aircraft and advised the G3 to expedite climb because he was only out of 5200 ft. At 5 mi, the G3 was at 5600 ft and I advised him of traffic. After the MD80 and the G3 crossed, I asked the G3 to verify he was level 6000 ft because his mode C was still indicating 5600 ft. He advised he was still at 5600 ft and climbing. I had advised both aircraft of situation several times and told the G3 to expedite but he seemed nonchalant about the separation. I believe my action was timely and initially thought there was a mode C problem with the aircraft's transponder or my ARTS.

Title: OPERROR OCCURRED BTWN AN ACR MD80 AND A CPR G3 WHEN RPTR DID NOT ENSURE ALT SEPARATION. RPTR THOUGHT THE G3 HAD A MODE C PROB. ACFT CROSSED WITH LTSS.
Narrative: CLBED S DEP OFF MMU TO 6000 FT AND VECTORED THE G3 TOWARDS COV VOR. RADAR IDENTED THE MD80 SW OF EWR AND TURNED ACFT NBOUND AND CLBED ACFT TO 5000 FT. WHEN ACFT WERE 8 MI APART, I CALLED TFC FOR BOTH ACFT AND ADVISED THE G3 TO EXPEDITE CLB BECAUSE HE WAS ONLY OUT OF 5200 FT. AT 5 MI, THE G3 WAS AT 5600 FT AND I ADVISED HIM OF TFC. AFTER THE MD80 AND THE G3 CROSSED, I ASKED THE G3 TO VERIFY HE WAS LEVEL 6000 FT BECAUSE HIS MODE C WAS STILL INDICATING 5600 FT. HE ADVISED HE WAS STILL AT 5600 FT AND CLBING. I HAD ADVISED BOTH ACFT OF SIT SEVERAL TIMES AND TOLD THE G3 TO EXPEDITE BUT HE SEEMED NONCHALANT ABOUT THE SEPARATION. I BELIEVE MY ACTION WAS TIMELY AND INITIALLY THOUGHT THERE WAS A MODE C PROB WITH THE ACFT'S XPONDER OR MY ARTS.
