Narrative:
Acting as captain I was PF on the ILS runway 17. WX was reported several scattered layers and 5 mi in haze. ATC advised us of a traffic helicopter to our left 500 ft and below. Neither the first officer or I heard tower clear the piper for takeoff. I was inside flying the approach, occasionally looking out. The TCASII gave us a TA. At that point the first officer acquired the target and the so did I. The piper was nose high climbing across the approach path at approximately 800 ft. I reduced power to flight idle and descended to about 2 DOT low on GS. The first officer queried tower and tower asked the piper why he wasn't heading 40 degrees as assigned on takeoff. The piper responded that he had been cleared on course. Tower said that was not the case. In our confign descending on GS we would not have collided, but it was a very close pass. The piper appeared very defensive about his right to go on course. In phl I have never ever heard my aircraft cleared for takeoff proceed on course. The TCASII did its job, but did not issue the TA as soon as I would have liked.

Title: BE02 FLC RECEIVES TCASII TA TAKES EVASIVE ACTION BY REDUCING PWR AND INCREASING DSCNT.
Narrative: ACTING AS CAPT I WAS PF ON THE ILS RWY 17. WX WAS RPTED SEVERAL SCATTERED LAYERS AND 5 MI IN HAZE. ATC ADVISED US OF A TFC HELI TO OUR L 500 FT AND BELOW. NEITHER THE FO OR I HEARD TWR CLR THE PIPER FOR TKOF. I WAS INSIDE FLYING THE APCH, OCCASIONALLY LOOKING OUT. THE TCASII GAVE US A TA. AT THAT POINT THE FO ACQUIRED THE TARGET AND THE SO DID I. THE PIPER WAS NOSE HIGH CLBING ACROSS THE APCH PATH AT APPROX 800 FT. I REDUCED PWR TO FLT IDLE AND DSNDED TO ABOUT 2 DOT LOW ON GS. THE FO QUERIED TWR AND TWR ASKED THE PIPER WHY HE WASN'T HDG 40 DEGS AS ASSIGNED ON TKOF. THE PIPER RESPONDED THAT HE HAD BEEN CLRED ON COURSE. TWR SAID THAT WAS NOT THE CASE.
