Narrative:

The falcon jet climbed through the assigned altitude of FL230 and so caused an incident with the twin cessna, level at FL240 on the same airway and direction. The cessna spotted the falcon passing by. The situation may have been less severe under the following conditions: 1) had traffic been called, 2) had the falcon pilot spoken better english, 3) had TCASII been present, 4) had the conflict alert feature of the scope not alternately turned off the data block display, and 5) had mode south been used.

Title: A CGA JET CLBED ABOVE ASSIGNED ALT AND CONFLICTED WITH ANOTHER ACFT IN LEVEL FLT. LTSS OCCURRED.

Narrative: THE FALCON JET CLBED THROUGH THE ASSIGNED ALT OF FL230 AND SO CAUSED AN INCIDENT WITH THE TWIN CESSNA, LEVEL AT FL240 ON THE SAME AIRWAY AND DIRECTION. THE SIT MAY HAVE BEEN LESS SEVERE UNDER THE FOLLOWING CONDITIONS: 1) HAD TFC BEEN CALLED, 2) HAD THE FALCON PLT SPOKEN BETTER ENGLISH, 3) HAD TCASII BEEN PRESENT, 4) HAD THE CONFLICT ALERT FEATURE OF THE SCOPE NOT ALTERNATELY TURNED OFF THE DATA BLOCK DISPLAY, AND 5) HAD MODE S BEEN USED.
