Narrative:
Aircraft #2 departed ewk airport, made left turn out, then appeared to enter left downwind. Aircraft #1 departed runway 17 ewk behind aircraft #2. Then made a straight out departure. Aircraft #1 then contacted ict approach control and requested vectors for the ILS runway 17 ewk. Ict approach called aircraft #2 as traffic for aircraft #1. Aircraft #1 acknowledged traffic in sight. Then received a vector to the northeast for the approach. While turning, aircraft #1 lost sight of aircraft #2. Aircraft #1 contacted ict approach and requested position of aircraft #2. Approach called traffic no factor. This is what actually happened: aircraft #2 turned south instead of north after making a left crosswind leg. Aircraft #1 while on a vector from approach passed over aircraft #2 clearing it by 200 ft vertical. All this is according to an FAA examiner who was riding in the rear seat of aircraft #1. The pilot of aircraft #1 was wearing IFR training hood and I was riding right seat as check airman candidate. The FAA examiner saw the imperative danger and did nothing to warn me or the pilot thus resulting in an near midair collision. Approach control reported aircraft #2 at 3700 ft and aircraft #1 was climbing through 3450 ft at time of incident. However, according to the FAA examiner we passed over aircraft #2 at 200 ft vertical separation. My evasive action was calling ict approach and requesting position of aircraft #2. I never did see this take place.
