Narrative:

After departure from ewr, as per ewr SID, aircraft turned to a heading off 220 degrees. ATC cleared flight to 10000 ft with no heading change. At approximately 8000 ft MSL, ATC asked if flight was in the turn to 310 degrees. First officer responded that we were never given a turn to 310 degrees, only a climb to 10000 ft MSL. ATC instructed flight to stop climb (no altitude was given). We leveled at 8800 ft MSL, and was told to turn immediately to a 310 degree heading. An RA was issued by TCASII, but we, captain and first officer, had the aircraft visually. If turn to 310 degree heading was given by ATC earlier, then ATC transmission was blocked.

Title: POTENTIAL CONFLICT BTWN ARR AND DEP TFC DURING RADAR VECTORING SID DEP PROC. ACFT X WAS NOT ON VECTOR HDG THAT DEP CTLR HAD ASSIGNED.

Narrative: AFTER DEP FROM EWR, AS PER EWR SID, ACFT TURNED TO A HDG OFF 220 DEGS. ATC CLRED FLT TO 10000 FT WITH NO HDG CHANGE. AT APPROX 8000 FT MSL, ATC ASKED IF FLT WAS IN THE TURN TO 310 DEGS. FO RESPONDED THAT WE WERE NEVER GIVEN A TURN TO 310 DEGS, ONLY A CLB TO 10000 FT MSL. ATC INSTRUCTED FLT TO STOP CLB (NO ALT WAS GIVEN). WE LEVELED AT 8800 FT MSL, AND WAS TOLD TO TURN IMMEDIATELY TO A 310 DEG HDG. AN RA WAS ISSUED BY TCASII, BUT WE, CAPT AND FO, HAD THE ACFT VISUALLY. IF TURN TO 310 DEG HDG WAS GIVEN BY ATC EARLIER, THEN ATC XMISSION WAS BLOCKED.
