Narrative:

A friend with identical qualifications flying my aircraft as PIC flew close to a local mountain top, where antenna maintenance personnel were working. While one could make the case for a 'landing or takeoff' exemption, we were probably too close to the work crew. I have heard that '2 or more' persons constitutes a congested area, and we certainly did not have the required distance for that.

Title: PLT OF AN SMA SEL FLEW BY A TV ANTENNA AT APPROX 109 FT DISTANCE WHERE MAINT PERSONS WERE WORKING WHEN IT WAS NOT NECESSARY FOR TKOF AND LNDG. THE ARPT WAS 4 MI AWAY AND NOT LINED UP WITH THE RWYS AND AT AN ALT ABOVE THE TFC PATTERN ALT.

WHILE ONE COULD MAKE THE CASE FOR A 'LNDG OR TKOF' EXEMPTION, WE WERE PROBABLY TOO CLOSE TO THE WORK CREW. I HAVE HEARD THAT '2 OR MORE' PERSONS CONSTITUTES A CONGESTED AREA, AND WE CERTAINLY DID NOT HAVE THE REQUIRED DISTANCE FOR THAT.
