Narrative:
After deplaning runway 4L, turned to 060 degree heading and began climb to 2500 ft. SID calls for 290 degree heading at 4 DME off 108.7. At approximately 3 mi and 1600-2000 ft, aircraft entered moderate turbulence. Airspeed and vsi showed a decreasing rate of climb and speed. I initiated the left turn to 290 degrees approximately 1 mi before the stated SID requirement. Departure control was advised but the transmission was blocked. By the time the frequency cleared, departure controller queried us on the premature turn and indicated that he had traffic out of teb he was concerned about. He further stated that he did not give us the turn. I was responding to existing conditions at the time with safety of flight my primary concern. Corrective action: slow the flow in and out of ewr. Build a contingency plan for radio frequency congestion.

Title: FLC OF A B737-100 TURNED EARLY ON A DEP SID RESULTING IN ATC COMPLAINING ABOUT POSSIBLE TFC CONFLICT AND REMINDING THEM THAT THEY HAD NOT BEEN INSTRUCTED TO TURN.
Narrative: AFTER DEPLANING RWY 4L, TURNED TO 060 DEG HDG AND BEGAN CLB TO 2500 FT. SID CALLS FOR 290 DEG HDG AT 4 DME OFF 108.7. AT APPROX 3 MI AND 1600-2000 FT, ACFT ENTERED MODERATE TURB. AIRSPD AND VSI SHOWED A DECREASING RATE OF CLB AND SPD. I INITIATED THE L TURN TO 290 DEGS APPROX 1 MI BEFORE THE STATED SID REQUIREMENT. DEP CTL WAS ADVISED BUT THE XMISSION WAS BLOCKED. BY THE TIME THE FREQ CLRED, DEP CTLR QUERIED US ON THE PREMATURE TURN AND INDICATED THAT HE HAD TFC OUT OF TEB HE WAS CONCERNED ABOUT. HE FURTHER STATED THAT HE DID NOT GIVE US THE TURN. I WAS RESPONDING TO EXISTING CONDITIONS AT THE TIME WITH SAFETY OF FLT MY PRIMARY CONCERN. CORRECTIVE ACTION: SLOW THE FLOW IN AND OUT OF EWR. BUILD A CONTINGENCY PLAN FOR RADIO FREQ CONGESTION.
