Narrative:

Cvg was down to single runway operations due to high winds after fropa. We were initially assigned runway 27 and was later assigned runway 18L because the wind velocity had fallen off. We were the first aircraft off runway 18L and the tower had not activated the runway 18L ILS which is used for the noise abatement climb out. We were about to alert the tower controller to this when he gave us 'maintain runway heading' with our takeoff clearance. An uneventful takeoff ensued. At 2000 ft AGL he handed us off to departure control and told us to 'fly the noise abatement.' I replied, 'unable runway 18L ILS inoperative.' he didn't acknowledge and I quickly switched to departure control. The captain overruled my action and returned to the tower frequency and never received an acknowledgement from the tower controller. We switched to departure and told him of the situation and he said he would relay the information to cvg tower. For all intents and purposes we were momentarily IMC, lost communication with tower with an illegal clearance.

Title: FLC OF AN MD88 WERE CLRED FOR A NOISE ABATEMENT DEP OF WHICH ATC DID NOT HAVE THE GND ILS EQUIP ACTIVATED. INSTEAD OF TALKING TO DEP CTL ABOUT THE PROB, THE CAPT TRIED TO GO BACK TO THE TWR FOR ACKNOWLEDGEMENT THAT THEY COULD NOT FOLLOW THE ILS. HE SHOULD HAVE GIVEN HIS PROB TO DEP CTL SINCE THEY ARE THE CTLING AGENT AFTER DEP.

AT 2000 FT AGL HE HANDED US OFF TO DEP CTL AND TOLD US TO 'FLY THE NOISE ABATEMENT.' I REPLIED, 'UNABLE RWY 18L ILS INOP.' HE DIDN'T ACKNOWLEDGE AND I QUICKLY SWITCHED TO DEP CTL. WE SWITCHED TO DEP AND TOLD HIM OF THE SIT AND HE SAID HE WOULD RELAY THE INFO TO CVG TWR. FOR ALL INTENTS AND PURPOSES WE WERE MOMENTARILY IMC, LOST COM WITH TWR WITH AN ILLEGAL CLRNC.
