Narrative:
The assigned clearance was the texoma 3 (tex.3 as requested by flight plan). Regional departure controller assigned, 'maintain runway heading' and then cleared us to 8000 ft MSL. We were cleared to another departure frequency and then to climb to 10000 ft MSL. Another controller voice assigned us heading 330 degrees, 17000 ft MSL and expedite through 10000 ft MSL. I saw a TCASII alert and looked below me. I saw an MD80 climbing towards me. I turned to the right, away from the MD80. The MD80 climbed through my altitude in front of me. I reduced power/airspeed to ensure separation and descended. When the MD80 was clear we accepted radar vectors to the TEX3 SID. The TCASII alerted me to look down during the climb and then it was purely see and avoid. The first officer didn't see the MD80 until it was right in front of us. There was no time to effectively communicate -- only time to avoid the MD80.

Title: AN NMAC OPERROR OCCURRED WHEN AN MD80 CLBED THROUGH THE ALT OF A CPR C550 AT 6000 FT IN A CLB. THE C550 FLC RECEIVED A TCASII ALERT AND VISUALLY SIGHTED AND TOOK EVASIVE ACTION TO AVOID THE MD80.
Narrative: THE ASSIGNED CLRNC WAS THE TEXOMA 3 (TEX.3 AS REQUESTED BY FLT PLAN). REGIONAL DEP CTLR ASSIGNED, 'MAINTAIN RWY HDG' AND THEN CLRED US TO 8000 FT MSL. WE WERE CLRED TO ANOTHER DEP FREQ AND THEN TO CLB TO 10000 FT MSL. ANOTHER CTLR VOICE ASSIGNED US HDG 330 DEGS, 17000 FT MSL AND EXPEDITE THROUGH 10000 FT MSL. I SAW A TCASII ALERT AND LOOKED BELOW ME. I SAW AN MD80 CLBING TOWARDS ME. I TURNED TO THE R, AWAY FROM THE MD80. THE MD80 CLBED THROUGH MY ALT IN FRONT OF ME. I REDUCED PWR/AIRSPD TO ENSURE SEPARATION AND DSNDED. WHEN THE MD80 WAS CLR WE ACCEPTED RADAR VECTORS TO THE TEX3 SID. THE TCASII ALERTED ME TO LOOK DOWN DURING THE CLB AND THEN IT WAS PURELY SEE AND AVOID. THE FO DIDN'T SEE THE MD80 UNTIL IT WAS RIGHT IN FRONT OF US. THERE WAS NO TIME TO EFFECTIVELY COMMUNICATE -- ONLY TIME TO AVOID THE MD80.
