Narrative:

On departure from iah, ATC cleared us direct to playa. Approaching 'cbrez,' ATC gave us a heading of 180 degrees at 5000 ft. Between cbrez and skuba the hard RA TCASII activated to climb. Aircraft climbed as instructed by TCASII. The TCASII displayed aircraft below us at approximately 100 ft as we were climbing through 5200 ft. We did not see the traffic. We reported TCASII activation to iah departure control. Thank god I wasn't following the elimination of the 250 KT restr below 10000 ft. That is too dangerous until all aircraft have mode C.

Title: AN ACR B737 FLC HAS AN NMAC WITH TFC AT THEIR ASSIGNED ALT. THEY FOLLOWED THE TCASII RA INSTRUCTIONS SUCCESSFULLY.

ACFT CLBED AS INSTRUCTED BY TCASII. THE TCASII DISPLAYED ACFT BELOW US AT APPROX 100 FT AS WE WERE CLBING THROUGH 5200 FT. WE DID NOT SEE THE TFC. WE RPTED TCASII ACTIVATION TO IAH DEP CTL. THANK GOD I WASN'T FOLLOWING THE ELIMINATION OF THE 250 KT RESTR BELOW 10000 FT. THAT IS TOO DANGEROUS UNTIL ALL ACFT HAVE MODE C.
