Narrative:
ZNY gave us 'cross sfk at FL240' while at cruise and approximately 100 mi out. We were tired after 4 legs and 10 hours on duty. My first officer was sick and should have been home because he wasn't 100%. This caused me to give extra attention to every detail all day long and was tiring. The altitude alerter is not in the normal scan for capts as it is on the first officer's side. At night it is hard to see the numbers on the alerter from the captain's seat. Center asked us if we were going to descend at the VOR. We had both forgotten the crossing restr. I should have written it down on my note pad like I usually do. My first officer should have called in sick. Center should not have given us the crossing restr so far out. An altitude alerter that can be easily seen from the left seat would help. We descended from FL280 to FL240 in 8 mi. The controller appeared to only want this so he could hand us off to ZOB at the predetermined altitude. No traffic was on our TCASII for 20 mi. Frequency congestion was heavy.

Title: DC9 ACFT WITH XING RESTR. FLC ILLNESS AND FATIGUE PLUS EARLY CLRNC CONTRIBUTED TO FAILING TO MAKE THE RESTR.
Narrative: ZNY GAVE US 'CROSS SFK AT FL240' WHILE AT CRUISE AND APPROX 100 MI OUT. WE WERE TIRED AFTER 4 LEGS AND 10 HRS ON DUTY. MY FO WAS SICK AND SHOULD HAVE BEEN HOME BECAUSE HE WASN'T 100%. THIS CAUSED ME TO GIVE EXTRA ATTN TO EVERY DETAIL ALL DAY LONG AND WAS TIRING. THE ALT ALERTER IS NOT IN THE NORMAL SCAN FOR CAPTS AS IT IS ON THE FO'S SIDE. AT NIGHT IT IS HARD TO SEE THE NUMBERS ON THE ALERTER FROM THE CAPT'S SEAT. CTR ASKED US IF WE WERE GOING TO DSND AT THE VOR. WE HAD BOTH FORGOTTEN THE XING RESTR. I SHOULD HAVE WRITTEN IT DOWN ON MY NOTE PAD LIKE I USUALLY DO. MY FO SHOULD HAVE CALLED IN SICK. CTR SHOULD NOT HAVE GIVEN US THE XING RESTR SO FAR OUT. AN ALT ALERTER THAT CAN BE EASILY SEEN FROM THE L SEAT WOULD HELP. WE DSNDED FROM FL280 TO FL240 IN 8 MI. THE CTLR APPEARED TO ONLY WANT THIS SO HE COULD HAND US OFF TO ZOB AT THE PREDETERMINED ALT. NO TFC WAS ON OUR TCASII FOR 20 MI. FREQ CONGESTION WAS HVY.
