Received clearance 10 DME prior to fix to cross at 12000 ft. Were at 17000 ft. Advised ZOB at 3 mi prior to mizar unable restr of 12000 ft at mizar due to late ATC clearance and tailwinds. ATC said do your best. Frequency got busy and could not get altitude restr removed. No traffic conflict apparent.
