Narrative:
After returning from break, the first officer and relief pilot informed me of confusion on altitude clearance and deviation. Gander center gave restr to cross 51n50w at or after YY25, received oceanic clearance via ACARS. Contacted gander oceanic clearance via voice and given choice of FL360 or FL390. Clearance then said 'cleared FL390 delete 50W crossing time.' returned to gander center while starting climb. First officer asked center to confirm clearance to FL390. Center then said clearance is not an ATC facility. First officer stopped climb at FL375. Gander center then cleared aircraft to climb to FL390 in same series of xmissions. First officer and relief pilot analyzed series of events and understand who can clear aircraft to new altitude.
Original NASA ASRS Text
Title: B767. FO AND RELIEF PLT RECEIVED AN ALT CLRNC FROM GANDER OCEANIC CLRNC DELIVERY. BASED ON THAT THEY STARTED A CLB TO THE CLRED ALT. WHEN THEY CONTACTED GANDER CTR THEY WERE INFORMED THAT THEY WERE NOT LEGAL TO CLB BASED ON THAT CLRNC.
Narrative: AFTER RETURNING FROM BREAK, THE FO AND RELIEF PLT INFORMED ME OF CONFUSION ON ALT CLRNC AND DEV. GANDER CTR GAVE RESTR TO CROSS 51N50W AT OR AFTER YY25, RECEIVED OCEANIC CLRNC VIA ACARS. CONTACTED GANDER OCEANIC CLRNC VIA VOICE AND GIVEN CHOICE OF FL360 OR FL390. CLRNC THEN SAID 'CLRED FL390 DELETE 50W XING TIME.' RETURNED TO GANDER CTR WHILE STARTING CLB. FO ASKED CTR TO CONFIRM CLRNC TO FL390. CTR THEN SAID CLRNC IS NOT AN ATC FACILITY. FO STOPPED CLB AT FL375. GANDER CTR THEN CLRED ACFT TO CLB TO FL390 IN SAME SERIES OF XMISSIONS. FO AND RELIEF PLT ANALYZED SERIES OF EVENTS AND UNDERSTAND WHO CAN CLR ACFT TO NEW ALT.
