Narrative:

At approximately XA40 pm, 25 mi west of eic, willey 1 departure, dfw, ATC issued climb to FL290. Switched controllers. ATC said 'direct pns reaching FL270.' ATC controller did not speak very clearly, I thought she said, 'stop at FL270.' I asked captain (PNF). He says, 'I did not hear her say that.' changed frequency again. ATC says, 'what's your altitude.' captain says FL280, climbing FL290. ATC said, 'you were issued FL270.' captain asked, 'do you want us to descend to FL270?' ATC advised, 'no, maintain FL290.' I think part of the problem was ATC was not being very clear about stopping the climb at FL270 and issuing direct to pns after FL270. Previous controller gave us an altitude of FL290. Captain did not seem to care too much about it. He could have called ATC back just to make sure we had to stop at FL270.

Title: DO328 FLC DOES NOT CLARIFY CLRNC, MISINTERPS ATC CLB INSTRUCTION TO FL270, AND CLBS TO FL290. ATC QUESTIONS FLC WHEN ALT IS OBSERVED AT FL280. PIC DISPUTES CLRNC. ATC REASSIGNS FL290 AS FINAL ASSIGNED ALT. FO, KNOWING THERE IS NO CLR UNDERSTANDING, PERCEIVES PIC SHOULD HAVE CLARIFIED CLRNC.

I THINK PART OF THE PROB WAS ATC WAS NOT BEING VERY CLR ABOUT STOPPING THE CLB AT FL270 AND ISSUING DIRECT TO PNS AFTER FL270. PREVIOUS CTLR GAVE US AN ALT OF FL290. CAPT DID NOT SEEM TO CARE TOO MUCH ABOUT IT. HE COULD HAVE CALLED ATC BACK JUST TO MAKE SURE WE HAD TO STOP AT FL270.
