Narrative:

Descending VFR into ptk working with detroit approach. ATC advised me to stop my descent at 6500 ft due to IFR traffic at 9:30-10 O'clock position. I advised I was going to continue descending into ptk and ATC pointed out traffic again. I responded with my call sign, I had the DC9 in sight. ATC advised me again and I told him I had him in sight. I was a little higher than the DC9. I knew I was going to miss the aircraft below or behind. His TCASII went off and made him climb. I always had visual with him. ATC never moved the DC9.

Title: PLT OF C402 HAS NMAC WITH DC9 WHOSE TCASII ACTIVATES.

Narrative: DSNDING VFR INTO PTK WORKING WITH DETROIT APCH. ATC ADVISED ME TO STOP MY DSCNT AT 6500 FT DUE TO IFR TFC AT 9:30-10 O'CLOCK POS. I ADVISED I WAS GOING TO CONTINUE DSNDING INTO PTK AND ATC POINTED OUT TFC AGAIN. I RESPONDED WITH MY CALL SIGN, I HAD THE DC9 IN SIGHT. ATC ADVISED ME AGAIN AND I TOLD HIM I HAD HIM IN SIGHT. I WAS A LITTLE HIGHER THAN THE DC9. I KNEW I WAS GOING TO MISS THE ACFT BELOW OR BEHIND. HIS TCASII WENT OFF AND MADE HIM CLB. I ALWAYS HAD VISUAL WITH HIM. ATC NEVER MOVED THE DC9.
