Narrative:
During climb out, realized that reaching minimum driftdown altitude may be in question by critical point which was gmn VOR. Queried ATC 3 times for higher altitude. Each time was told would be given higher when able. Finally advised ATC if minimum altitude of 14000 ft was not reached by gmn that I would have to initiate a 360 degree turn for the climb. After being told this controller advised that 'driftdown' has no meaning to him and gave me a climb to 13000 ft. Knowing traffic was behind, I decided to continue to avoid turning directly back into traffic and also having departed below the aircraft's maximum takeoff weight for driftdown to be used, I knew I could meet the required performance. Upon arriving at the destination, I called ATC on the phone to explain driftdown requirements and supervising controller stated that they were aware of them. However, due to unavoidable traffic situation, they could not issue an altitude change.

Title: A BA3100 FLC IS DENIED, BY ATC, THE ALT NEEDED FOR DRIFTDOWN COMPLIANCE WHILE APCHING GMN, CA.
Narrative: DURING CLBOUT, REALIZED THAT REACHING MINIMUM DRIFTDOWN ALT MAY BE IN QUESTION BY CRITICAL POINT WHICH WAS GMN VOR. QUERIED ATC 3 TIMES FOR HIGHER ALT. EACH TIME WAS TOLD WOULD BE GIVEN HIGHER WHEN ABLE. FINALLY ADVISED ATC IF MINIMUM ALT OF 14000 FT WAS NOT REACHED BY GMN THAT I WOULD HAVE TO INITIATE A 360 DEG TURN FOR THE CLB. AFTER BEING TOLD THIS CTLR ADVISED THAT 'DRIFTDOWN' HAS NO MEANING TO HIM AND GAVE ME A CLB TO 13000 FT. KNOWING TFC WAS BEHIND, I DECIDED TO CONTINUE TO AVOID TURNING DIRECTLY BACK INTO TFC AND ALSO HAVING DEPARTED BELOW THE ACFT'S MAX TKOF WT FOR DRIFTDOWN TO BE USED, I KNEW I COULD MEET THE REQUIRED PERFORMANCE. UPON ARRIVING AT THE DEST, I CALLED ATC ON THE PHONE TO EXPLAIN DRIFTDOWN REQUIREMENTS AND SUPERVISING CTLR STATED THAT THEY WERE AWARE OF THEM. HOWEVER, DUE TO UNAVOIDABLE TFC SIT, THEY COULD NOT ISSUE AN ALT CHANGE.
