Narrative:

The issue is time and duty. We were scheduled to fly dtw- las, break duty for 6 hours 5 mins and fly las-dtw for 10 hours 20 mins duty and 7 hours 50 mins hard fly. However, we diverted to den for WX then returned to las for 8 hours 20 mins duty time and 6 hours 4 mins hard time. Our flight to dtw was delayed 2+ hours. Company crew schedules said that since this trip was scheduled legal (under 8 hours hard fly) and that the projected overage was due to WX, we were legal to continue our series of trips that day (still under 16+ hour duty). We departed las and arrived dtw 3 hours 20 mins hard fly and an additional duty period of 4 hours 35 mins. Total duty for the day was 12 hours 55 mins and total hard fly was 9 hours 24 mins. Our company has used this interpretation consistently in the past but now with some management changes and pilot group on the property, some feel this to be incorrect. My crew was caught in the middle and elected to continue the flight believing we were scheduled legally. For clarification in operating under supplemental rules for this charter flying, my crew would appreciate any clarification available on this type of situation. Callback conversation with reporter revealed the following information: reporter was quoted section 121.507 of the FARS with regard to the duty time permitted with a 3 person crew operating under a supplemental air carrier certificate. Over 8 hours of flight time, up to 12 hours is permitted.

Title: CAPT OF AN ACR SUPPLEMENTAL OPERATED DC10-15 QUESTIONED HIS FLT DUTY GOING OVER 8 HRS OF FLT TIME IN A 24 HR PERIOD EVEN THOUGH IT WAS NOT SCHEDULED TO GO OVER 8 HRS.

MY CREW WAS CAUGHT IN THE MIDDLE AND ELECTED TO CONTINUE THE FLT BELIEVING WE WERE SCHEDULED LEGALLY. FOR CLARIFICATION IN OPERATING UNDER SUPPLEMENTAL RULES FOR THIS CHARTER FLYING, MY CREW WOULD APPRECIATE ANY CLARIFICATION AVAILABLE ON THIS TYPE OF SIT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR WAS QUOTED SECTION 121.507 OF THE FARS WITH REGARD TO THE DUTY TIME PERMITTED WITH A 3 PERSON CREW OPERATING UNDER A SUPPLEMENTAL ACR CERTIFICATE. OVER 8 HRS OF FLT TIME, UP TO 12 HRS IS PERMITTED.
