Narrative:
Departed bwi on passenger flight to mdt. Captain was PF. Climb checklist is to be done silently by PNF and requires no participation by PF. At cruise altitude, I noticed that we were flying at a slower than normal speed and was trying to determine why when the first officer, apparently doing the same thing, discovered that the flaps had not been retracted from the 5 degree position, as required by the climb checklist. At this time we had exceeded the 5 degree flap speed by 40 KTS. Inspection by a mechanic determined that no damage had occurred. Most other checklists require a challenge and response format. Since this occurrence is not an isolated event, it seems that the 'silent' checklist should have a confirmation that flaps and gear are retracted. Note: first officer did use the checklist and did not depend on memory. The flap position was missed due to a short memory lapse and was not due to a short overnight or lack of sleep.

Title: CAPT OF A DEHAVILLAND DASH 8 (DH8) EXCEEDED THE WING FLAP SPD RESTR AFTER THE FO FORGOT TO RETRACT THEM DURING CLB CHKLIST.
Narrative: DEPARTED BWI ON PAX FLT TO MDT. CAPT WAS PF. CLB CHKLIST IS TO BE DONE SILENTLY BY PNF AND REQUIRES NO PARTICIPATION BY PF. AT CRUISE ALT, I NOTICED THAT WE WERE FLYING AT A SLOWER THAN NORMAL SPD AND WAS TRYING TO DETERMINE WHY WHEN THE FO, APPARENTLY DOING THE SAME THING, DISCOVERED THAT THE FLAPS HAD NOT BEEN RETRACTED FROM THE 5 DEG POS, AS REQUIRED BY THE CLB CHKLIST. AT THIS TIME WE HAD EXCEEDED THE 5 DEG FLAP SPD BY 40 KTS. INSPECTION BY A MECH DETERMINED THAT NO DAMAGE HAD OCCURRED. MOST OTHER CHKLISTS REQUIRE A CHALLENGE AND RESPONSE FORMAT.
