Narrative:
Departure controller asked us (X) to accelerate to 320 KTS reaching 10000 ft and then climb to 17000 ft. We complied and started to climb. At about 10300 ft and climbing at 2000 FPM we got TCASII warning to descend with traffic (Y) at 10 O'clock position, 5 mi, descending and showing 300 ft above us. We pushed nose over to descend as smoothly as possible but under circumstances going from 2000 ft up to 2000 ft down with TCASII saying 'descend,' I might not have been as smooth as the passenger might have liked. We advised ATC we were responding to TCASII and he gave us a 20 degree turn to the right which resolved the conflict. Controller asked if he had given us a turn to the right earlier and we told him we did not hear such an instruction. We proceeded without further incident. We were in IMC when this occurred.

Narrative: DEP CTLR ASKED US (X) TO ACCELERATE TO 320 KTS REACHING 10000 FT AND THEN CLB TO 17000 FT. WE COMPLIED AND STARTED TO CLB. AT ABOUT 10300 FT AND CLBING AT 2000 FPM WE GOT TCASII WARNING TO DSND WITH TFC (Y) AT 10 O'CLOCK POS, 5 MI, DSNDING AND SHOWING 300 FT ABOVE US. WE PUSHED NOSE OVER TO DSND AS SMOOTHLY AS POSSIBLE BUT UNDER CIRCUMSTANCES GOING FROM 2000 FT UP TO 2000 FT DOWN WITH TCASII SAYING 'DSND,' I MIGHT NOT HAVE BEEN AS SMOOTH AS THE PAX MIGHT HAVE LIKED. WE ADVISED ATC WE WERE RESPONDING TO TCASII AND HE GAVE US A 20 DEG TURN TO THE R WHICH RESOLVED THE CONFLICT. CTLR ASKED IF HE HAD GIVEN US A TURN TO THE R EARLIER AND WE TOLD HIM WE DID NOT HEAR SUCH AN INSTRUCTION. WE PROCEEDED WITHOUT FURTHER INCIDENT. WE WERE IN IMC WHEN THIS OCCURRED.
