Narrative:
I was acting as the PF in an EMB145 regional jet. The captain was performing the PNF duties. The takeoff was normal and upon reaching acceleration altitude I made the required calls. At this point the PNF should have retracted the flaps. He however neglected to do this. We therefore exceeded the flaps 9 degree limitations. As soon as we realized the flaps had not been retracted we did so and after conferring together, decided to continue the flight to our destination. We arrived safely and informed maintenance of the aircraft logbook write-up. The EMB145 does not have any flap overspd warnings. Supplemental information from acn 437386: at acceleration altitude received numerous ATC calls, clearance changes, TA's which distracted flight crew and we left the flaps in the takeoff position. Crew selected flaps up when aircraft wasn't accelerating as it should.

Title: AN EMB145 FLC ALLOWS THE ACFT TO EXCEED MAX FLAP SPD ON DEP FROM XNA, AR.
Narrative: I WAS ACTING AS THE PF IN AN EMB145 REGIONAL JET. THE CAPT WAS PERFORMING THE PNF DUTIES. THE TKOF WAS NORMAL AND UPON REACHING ACCELERATION ALT I MADE THE REQUIRED CALLS. AT THIS POINT THE PNF SHOULD HAVE RETRACTED THE FLAPS. HE HOWEVER NEGLECTED TO DO THIS. WE THEREFORE EXCEEDED THE FLAPS 9 DEG LIMITATIONS. AS SOON AS WE REALIZED THE FLAPS HAD NOT BEEN RETRACTED WE DID SO AND AFTER CONFERRING TOGETHER, DECIDED TO CONTINUE THE FLT TO OUR DEST. WE ARRIVED SAFELY AND INFORMED MAINT OF THE ACFT LOGBOOK WRITE-UP. THE EMB145 DOES NOT HAVE ANY FLAP OVERSPD WARNINGS. SUPPLEMENTAL INFO FROM ACN 437386: AT ACCELERATION ALT RECEIVED NUMEROUS ATC CALLS, CLRNC CHANGES, TA'S WHICH DISTRACTED FLC AND WE LEFT THE FLAPS IN THE TKOF POS. CREW SELECTED FLAPS UP WHEN ACFT WASN'T ACCELERATING AS IT SHOULD.
