Narrative:
6.2 infectious substances and 6.1 toxic or poison loaded on the aircraft on the upper deck where if spilled could due to airflow of pressurization system and or contact infect a crew member(south). This on flight phl to iln sep/xa/99. As previously reported is legal. This hazmat, however, is cargo aircraft only and cannot be shipped with foodstuff. I doubt that because of the number of passenger that were contaminated that this was deemed cargo aircraft only. I suspect that this was a judgement (good) call when the regulation was made. I think that it is equally important to not infect crews of cargo airlines as well as passenger or passenger crews. Solution: require that these and similar hazmats be shipped in the belly compartments where there is no access to the crews.

Title: CAPT OF A DC8-61 CARGO ACFT COMPLAINT OF TOXIC OR POISON HAZMAT CARRIED ON UPPER DECK LEGALLY COULD CAUSE CREW MEMBERS TO BE AFFECTED IF SPILLED DURING FLT.
Narrative: 6.2 INFECTIOUS SUBSTANCES AND 6.1 TOXIC OR POISON LOADED ON THE ACFT ON THE UPPER DECK WHERE IF SPILLED COULD DUE TO AIRFLOW OF PRESSURIZATION SYS AND OR CONTACT INFECT A CREW MEMBER(S). THIS ON FLT PHL TO ILN SEP/XA/99. AS PREVIOUSLY RPTED IS LEGAL. THIS HAZMAT, HOWEVER, IS CARGO ACFT ONLY AND CANNOT BE SHIPPED WITH FOODSTUFF. I DOUBT THAT BECAUSE OF THE NUMBER OF PAX THAT WERE CONTAMINATED THAT THIS WAS DEEMED CARGO ACFT ONLY. I SUSPECT THAT THIS WAS A JUDGEMENT (GOOD) CALL WHEN THE REG WAS MADE.
