Narrative:
Center must have been aware of the possible conflict because we were directed to stop our climb at FL280 several mins before the conflict. Other aircraft was told to level at FL290, but overshot down to approximately FL288, which triggered our TCASII TA as other aircraft overflew our left side. The pilot of other aircraft thought that we were an F16 as he sighted us. We're glad to have TCASII.

Title: B767ER RECEIVES TCASII TA AS DSNDING TFC OVERSHOOTS LEVELOFF NEAR GRD.
Narrative: CTR MUST HAVE BEEN AWARE OF THE POSSIBLE CONFLICT BECAUSE WE WERE DIRECTED TO STOP OUR CLB AT FL280 SEVERAL MINS BEFORE THE CONFLICT. OTHER ACFT WAS TOLD TO LEVEL AT FL290, BUT OVERSHOT DOWN TO APPROX FL288, WHICH TRIGGERED OUR TCASII TA AS OTHER ACFT OVERFLEW OUR L SIDE. THE PLT OF OTHER ACFT THOUGHT THAT WE WERE AN F16 AS HE SIGHTED US. WE'RE GLAD TO HAVE TCASII.
