Narrative:
Bosa 2 abl departure, issued FL200 crossing restr at marte intersection. Captain stated 'unable.' reissued FL180 crossing restr. Captain stated unable. Reissued FL160 crossing restr. Captain responded that he was not sure he could comply -- unlikely. Controller acknowledged numerous xmissions in spanish. Approaching marte intersection at 14600 ft MSL, TCASII displayed a TA. Visual on traffic acquired at 10 O'clock, slightly high. Traffic continued descent through our altitude, approximately 2 NM abeam. Sun angle was factor in late visual on traffic. Controller informed by captain of 'close call,' traffic inside 2 NM. Supplemental information from acn 458957: at marte intersection, TCASII issued a TA. First so, and then the captain, acquired visual on traffic. Supplemental information from acn 458960: TCASII gave us TA and displayed other aircraft approaching but to left side. It descended through our altitude about 1 1/2 - 2 mi abeam. I do not know if traffic saw us or not, but I believe separation was less than acceptable.
