Narrative:
Departing teb on jul/xa/00 at approximately XA15, we were cleared to depart runway 1 and fly the teb 4 departure. Shortly after takeoff and entering IMC, we checked in with new york departure control. We were given a climb, heading change, and altitude change and asked to squawk a new code. The frequency was very busy, our readback was not acknowledged until the third try. By this time we were climbing through 6800 ft. At this time the controller told us we were only cleared to 4000 ft, we had been trying to read back 'climb to 8000 ft turn left to 280 degrees' and the new transponder code. We leveled off at 7000 ft. I believe that because of frequency congestion and our inability to receive a confirmation that we had the correct information, were the causes of this incident.

Title: CLRNC NOT ACKNOWLEDGED UNTIL ACR WAS ABOVE INTENDED ALT. FREQ CONGESTION WAS AN ISSUE.
Narrative: DEPARTING TEB ON JUL/XA/00 AT APPROX XA15, WE WERE CLRED TO DEPART RWY 1 AND FLY THE TEB 4 DEP. SHORTLY AFTER TKOF AND ENTERING IMC, WE CHKED IN WITH NEW YORK DEP CTL. WE WERE GIVEN A CLB, HDG CHANGE, AND ALT CHANGE AND ASKED TO SQUAWK A NEW CODE. THE FREQ WAS VERY BUSY, OUR READBACK WAS NOT ACKNOWLEDGED UNTIL THE THIRD TRY. BY THIS TIME WE WERE CLBING THROUGH 6800 FT. AT THIS TIME THE CTLR TOLD US WE WERE ONLY CLRED TO 4000 FT, WE HAD BEEN TRYING TO READ BACK 'CLB TO 8000 FT TURN L TO 280 DEGS' AND THE NEW XPONDER CODE. WE LEVELED OFF AT 7000 FT. I BELIEVE THAT BECAUSE OF FREQ CONGESTION AND OUR INABILITY TO RECEIVE A CONFIRMATION THAT WE HAD THE CORRECT INFO, WERE THE CAUSES OF THIS INCIDENT.
