Narrative:

With an RA on climb out to pahokee climbing through 11000 ft with a visual contact at 3 O'clock position and 500 ft below and climbing, the RA directed a descent 2500 FPM and at the same time the controller directed us to expedite climb. As captain, I commanded the first officer who was flying to follow the controller's instruction as the safest response. By following the RA directions we would have descended through the altitude of the visual target. The expedited climb to FL230 resulted in the traffic to pass behind and below. I observed the traffic as 3 mi horizontal and 500 ft vertical at the closest point. I believe controller error in having a close encounter, but used captain's authority/authorized to deviate from a commanded RA instruction.

Title: ACR CREW ELECTS TO NOT FOLLOW TCASII RA WITH TFC IN SIGHT AND ATC CLRNC TO CLB INSTEAD OF DSND AS COMMANDED BY TCASII.

Narrative: WITH AN RA ON CLBOUT TO PAHOKEE CLBING THROUGH 11000 FT WITH A VISUAL CONTACT AT 3 O'CLOCK POS AND 500 FT BELOW AND CLBING, THE RA DIRECTED A DSCNT 2500 FPM AND AT THE SAME TIME THE CTLR DIRECTED US TO EXPEDITE CLB. AS CAPT, I COMMANDED THE FO WHO WAS FLYING TO FOLLOW THE CTLR'S INSTRUCTION AS THE SAFEST RESPONSE. BY FOLLOWING THE RA DIRECTIONS WE WOULD HAVE DSNDED THROUGH THE ALT OF THE VISUAL TARGET. THE EXPEDITED CLB TO FL230 RESULTED IN THE TFC TO PASS BEHIND AND BELOW. I OBSERVED THE TFC AS 3 MI HORIZ AND 500 FT VERT AT THE CLOSEST POINT. I BELIEVE CTLR ERROR IN HAVING A CLOSE ENCOUNTER, BUT USED CAPT'S AUTH TO DEVIATE FROM A COMMANDED RA INSTRUCTION.
