Narrative:
It was a normal takeoff from atl. We were given vectors to the south of atlanta for WX. We were given a 270 degree heading and 13000 ft MSL altitude. The controller called traffic at 11 O'clock position and 5 mi at 18000 ft MSL descending. We reported traffic in sight. Controller then asked the commuter if he had us in sight. He acknowledged he did. Controller then cleared us to FL230, maintain visual with the traffic. We started a climb, and shortly thereafter we got a TA followed by an RA (to climb). We expedited climb and turned away from traffic. The commuter said he was turning to the right for more separation. We estimate passing 7500 ft horizontal and 1500 ft vertical from traffic. It was a very uncomfortable situation at night. In hindsight we should have refused the clearance stating we were unable to maintain visual with traffic.
Original NASA ASRS Text
Title: FLC OF A B767-300 COMPLAINS ABOUT DEP CTL SEPARATING TFC VISUALLY AT NIGHT AROUND TSTM WX ACTIVITY.
Narrative: IT WAS A NORMAL TKOF FROM ATL. WE WERE GIVEN VECTORS TO THE S OF ATLANTA FOR WX. WE WERE GIVEN A 270 DEG HDG AND 13000 FT MSL ALT. THE CTLR CALLED TFC AT 11 O'CLOCK POS AND 5 MI AT 18000 FT MSL DSNDING. WE RPTED TFC IN SIGHT. CTLR THEN ASKED THE COMMUTER IF HE HAD US IN SIGHT. HE ACKNOWLEDGED HE DID. CTLR THEN CLRED US TO FL230, MAINTAIN VISUAL WITH THE TFC. WE STARTED A CLB, AND SHORTLY THEREAFTER WE GOT A TA FOLLOWED BY AN RA (TO CLB). WE EXPEDITED CLB AND TURNED AWAY FROM TFC. THE COMMUTER SAID HE WAS TURNING TO THE R FOR MORE SEPARATION. WE ESTIMATE PASSING 7500 FT HORIZ AND 1500 FT VERT FROM TFC. IT WAS A VERY UNCOMFORTABLE SIT AT NIGHT. IN HINDSIGHT WE SHOULD HAVE REFUSED THE CLRNC STATING WE WERE UNABLE TO MAINTAIN VISUAL WITH TFC.
