Narrative:
Predep checks were normal and we were given clearance to taxi to runway 9L for departure in ord. All flows and checklists were SOP as we approached the runway for departure. After the preceding air carrier Z airplane began its takeoff roll, we were given clearance to taxi into position and hold runway 9L. This clearance was read back by my copilot. As I aligned the aircraft with the runway centerline, we received takeoff clearance and were instructed to fly runway heading. After my copilot read back the clearance, I xferred control of the aircraft to him and I took control of the radios. After passing V1 and vr, my copilot announced 'what is that guy doing?' as the nosewheel lifted for takeoff, we both observed an air carrier Y B767 pass from right to left at the intersection in front of us. We estimate that we climbed above them by no more than 200 ft as their tail left the intersection. Immediately, tower yelled, 'air carrier Y, what are you doing?' they replied, 'uh, I thought we had takeoff clearance....' we copied down a phone number to call once we landed and after contacting departure control, the remainder of the flight was without incident. ATC later advised us that according to the tapes. Air carrier Y did not have nor did they acknowledge a takeoff clearance.

Title: A B737-300 FLT ROTATES OVER AND NARROWLY MISSES A B767 THAT HAD CROSSED THEIR TKOF RWY 9L AT ORD, IL.
Narrative: PREDEP CHKS WERE NORMAL AND WE WERE GIVEN CLRNC TO TAXI TO RWY 9L FOR DEP IN ORD. ALL FLOWS AND CHKLISTS WERE SOP AS WE APCHED THE RWY FOR DEP. AFTER THE PRECEDING ACR Z AIRPLANE BEGAN ITS TKOF ROLL, WE WERE GIVEN CLRNC TO TAXI INTO POS AND HOLD RWY 9L. THIS CLRNC WAS READ BACK BY MY COPLT. AS I ALIGNED THE ACFT WITH THE RWY CTRLINE, WE RECEIVED TKOF CLRNC AND WERE INSTRUCTED TO FLY RWY HDG. AFTER MY COPLT READ BACK THE CLRNC, I XFERRED CTL OF THE ACFT TO HIM AND I TOOK CTL OF THE RADIOS. AFTER PASSING V1 AND VR, MY COPLT ANNOUNCED 'WHAT IS THAT GUY DOING?' AS THE NOSEWHEEL LIFTED FOR TKOF, WE BOTH OBSERVED AN ACR Y B767 PASS FROM R TO L AT THE INTXN IN FRONT OF US. WE ESTIMATE THAT WE CLBED ABOVE THEM BY NO MORE THAN 200 FT AS THEIR TAIL LEFT THE INTXN. IMMEDIATELY, TWR YELLED, 'ACR Y, WHAT ARE YOU DOING?' THEY REPLIED, 'UH, I THOUGHT WE HAD TKOF CLRNC....' WE COPIED DOWN A PHONE NUMBER TO CALL ONCE WE LANDED AND AFTER CONTACTING DEP CTL, THE REMAINDER OF THE FLT WAS WITHOUT INCIDENT. ATC LATER ADVISED US THAT ACCORDING TO THE TAPES. ACR Y DID NOT HAVE NOR DID THEY ACKNOWLEDGE A TKOF CLRNC.
