Narrative:

Flight was weight capped to 97 passenger. Flight was boarded to 114 passenger and 1 jump seat. Agents attempted to entice passenger to take later flight and no one would deplane. The door was closed. We taxied to be deiced. After deicing operation instructed us to return to gate to remove baggage for weight and balance purposes. We had burned fuel from 31.1 to 30.3 (800 pounds) and they removed bags. Our new taxi weight was 117480 pounds (maximum taxi weight = 117500 pounds). We queried operations and bos maintenance as to whether a maintenance logbook entry was necessary. Bos maintenance told us there was no inspection needed for an overweight taxi. Contributing factors: we failed to ask gate agent why it was now ok for 114 passenger when they were trying to get passenger to volunteer to deplane. We should have requested final weight and balance before pushing off gate.
