Narrative:

I am a first officer on a BE1900D commuter plane operating under far 121. On apr/wed/01, I was part of a crew on flight originating in boston with destination of westchester county airport. We had 6 passenger and crew onboard. At about XA30, we were cleared for the sound visual runway 34 at westchester county by new york approach. Prior to flying south of the shoreline, we were at 3000 ft MSL when ATC came back to us and said 'I told you to maintain 2000 ft MSL. You should be at 2000 ft.' apparently, ATC wasn't clear on his instructions to us because we were flying the approach as per the published approach plate (10-1). I believe the situation could have been prevented if we (the crew) questioned the new york approach controller when we were unsure of the clearance. No conflict resulted from this situation.

WE HAD 6 PAX AND CREW ONBOARD. AT ABOUT XA30, WE WERE CLRED FOR THE SOUND VISUAL RWY 34 AT WESTCHESTER COUNTY BY NEW YORK APCH. PRIOR TO FLYING S OF THE SHORELINE, WE WERE AT 3000 FT MSL WHEN ATC CAME BACK TO US AND SAID 'I TOLD YOU TO MAINTAIN 2000 FT MSL. YOU SHOULD BE AT 2000 FT.' APPARENTLY, ATC WASN'T CLR ON HIS INSTRUCTIONS TO US BECAUSE WE WERE FLYING THE APCH AS PER THE PUBLISHED APCH PLATE (10-1). I BELIEVE THE SIT COULD HAVE BEEN PREVENTED IF WE (THE CREW) QUESTIONED THE NEW YORK APCH CTLR WHEN WE WERE UNSURE OF THE CLRNC. NO CONFLICT RESULTED FROM THIS SIT.
