Narrative:
Part 135 air taxi reposition flight from newark (ewr) to linden (ldj), nj. Six NM, no passenger. This event occurred the week after wtc attack. WX was clear, in class B airspace, on IFR clearance. Takeoff, enroute, approach the landing were uneventful. Three days later I realized trip may have been in violation of 25 NM no fly zone imposed around ny area banning part 91 flts and restricting some 135 flts. A thorough NOTAM check prior to flight revealed no restrictions regarding part 135 IFR operations at linden. There restrs regarding newark -- all flts must be part 135 and on an IFR flight plan -- were complied with. Newark ATC, the governing agency for linden, was not aware of restrs at linden. Newark ATC issued us an IFR clearance for the short (6NM) trip from newark to linden. Cause: FAA lack of providing current, real time NOTAM information to flight crews and ATC personnel. If something as important as closing an airport isn't in NOTAMS how are flight crews going to know? Airport/airspace closure information must be included I airport NOTAMS!
Original NASA ASRS Text
Title: BEECH 200 CAPT NOTICED THAT HE HAD BEEN IN NON-COMPLIANCE WITH THE ATC NOTAM RESTRICTING CERTAIN FLTS FROM A 25 MILE RADIUS OF NY WHEN HE MADE A NON PT 135 IFR REPOSITION FLT FROM EWR TO LDJ.
Narrative: PART 135 AIR TAXI REPOSITION FLT FROM NEWARK (EWR) TO LINDEN (LDJ), NJ. SIX NM, NO PAX. THIS EVENT OCCURRED THE WEEK AFTER WTC ATTACK. WX WAS CLR, IN CLASS B AIRSPACE, ON IFR CLRNC. TKOF, ENROUTE, APCH THE LNDG WERE UNEVENTFUL. THREE DAYS LATER I REALIZED TRIP MAY HAVE BEEN IN VIOLATION OF 25 NM NO FLY ZONE IMPOSED AROUND NY AREA BANNING PART 91 FLTS AND RESTRICTING SOME 135 FLTS. A THOROUGH NOTAM CHK PRIOR TO FLT REVEALED NO RESTRICTIONS REGARDING PART 135 IFR OPS AT LINDEN. THERE RESTRS REGARDING NEWARK -- ALL FLTS MUST BE PART 135 AND ON AN IFR FLT PLAN -- WERE COMPLIED WITH. NEWARK ATC, THE GOVERNING AGENCY FOR LINDEN, WAS NOT AWARE OF RESTRS AT LINDEN. NEWARK ATC ISSUED US AN IFR CLRNC FOR THE SHORT (6NM) TRIP FROM NEWARK TO LINDEN. CAUSE: FAA LACK OF PROVIDING CURRENT, REAL TIME NOTAM INFO TO FLT CREWS AND ATC PERSONNEL. IF SOMETHING AS IMPORTANT AS CLOSING AN ARPT ISN'T IN NOTAMS HOW ARE FLT CREWS GOING TO KNOW? ARPT/AIRSPACE CLOSURE INFO MUST BE INCLUDED I ARPT NOTAMS!
