Narrative:
Climbing out of tpa, ZJX advised traffic at 12 O'clock position ahead, BE36, at 13500 ft. We looked on TCASII and saw he was at 13500 ft. We were passing 11500 ft. He told BE36 we were climbing to FL200, but we had been assigned FL260. Controller confused and had we not leveled at 11700 ft we would have climbed into BE36 (near midair collision or midair). Told controller, and his response was an 'I don't care' attitude. Advised controller we would file a report on his attitude. 'Whatever' was his response. Callback conversation with reporter revealed the following information: reporter stated that he has had an increasing number of incidents where controllers have had a poor attitude or displayed poor technique in separation of aircraft. He is quite concerned about this trend, that this seems to be spreading throughout the system. He feels that there is a certain level of discontentment within their ranks -- again.

Title: POTENTIAL TFC CONFLICT AVERTED AS PIC OF AN MD80 TAKES PRECAUTIONARY AVOIDANCE ON A LEVELOFF FOR A XING BE36 ABOVE HIS FLT PATH.
Narrative: CLBING OUT OF TPA, ZJX ADVISED TFC AT 12 O'CLOCK POS AHEAD, BE36, AT 13500 FT. WE LOOKED ON TCASII AND SAW HE WAS AT 13500 FT. WE WERE PASSING 11500 FT. HE TOLD BE36 WE WERE CLBING TO FL200, BUT WE HAD BEEN ASSIGNED FL260. CTLR CONFUSED AND HAD WE NOT LEVELED AT 11700 FT WE WOULD HAVE CLBED INTO BE36 (NMAC OR MIDAIR). TOLD CTLR, AND HIS RESPONSE WAS AN 'I DON'T CARE' ATTITUDE. ADVISED CTLR WE WOULD FILE A RPT ON HIS ATTITUDE. 'WHATEVER' WAS HIS RESPONSE. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATED THAT HE HAS HAD AN INCREASING NUMBER OF INCIDENTS WHERE CTLRS HAVE HAD A POOR ATTITUDE OR DISPLAYED POOR TECHNIQUE IN SEPARATION OF ACFT. HE IS QUITE CONCERNED ABOUT THIS TREND, THAT THIS SEEMS TO BE SPREADING THROUGHOUT THE SYS. HE FEELS THAT THERE IS A CERTAIN LEVEL OF DISCONTENTMENT WITHIN THEIR RANKS -- AGAIN.
