Narrative:
On 07/tue/02, aircraft X remained overnight at ZZZ for pmv with a scheduled L-4 window removal and replacement due to a shattered inner pane. Window heat was rendered inoperative. Shattered window was on maintenance note. Window heat was placed on MEL at the time the window was maintenance noted. Looking at air carrier X MEL procedure 30-11, note: 'cracked or delaminated windows are not deferrable using MEL relief contact maintenance control for maintenance manual procedures. Will determine aircraft airworthiness.' I feel we did use MEL relief. In this case, it would make sense to me that it was intended that window heat be operative on a window that has some damage. This would help the window be less susceptible to further damage. Maintenance control was contacted on the phone and said this is common practice by some master operator MEL by boeing.

Title: A B737-300 WAS DISPATCHED IN NON COMPLIANCE WITH A DEFERRED L #4 EYEBROW WINDOW INNER PANE SHATTERED IN CONFLICT WITH THE MEL.
Narrative: ON 07/TUE/02, ACFT X REMAINED OVERNIGHT AT ZZZ FOR PMV WITH A SCHEDULED L-4 WINDOW REMOVAL AND REPLACEMENT DUE TO A SHATTERED INNER PANE. WINDOW HEAT WAS RENDERED INOP. SHATTERED WINDOW WAS ON MAINT NOTE. WINDOW HEAT WAS PLACED ON MEL AT THE TIME THE WINDOW WAS MAINT NOTED. LOOKING AT ACR X MEL PROC 30-11, NOTE: 'CRACKED OR DELAMINATED WINDOWS ARE NOT DEFERRABLE USING MEL RELIEF CONTACT MAINT CTL FOR MAINT MANUAL PROCS. WILL DETERMINE ACFT AIRWORTHINESS.' I FEEL WE DID USE MEL RELIEF. IN THIS CASE, IT WOULD MAKE SENSE TO ME THAT IT WAS INTENDED THAT WINDOW HEAT BE OPERATIVE ON A WINDOW THAT HAS SOME DAMAGE. THIS WOULD HELP THE WINDOW BE LESS SUSCEPTIBLE TO FURTHER DAMAGE. MAINT CTL WAS CONTACTED ON THE PHONE AND SAID THIS IS COMMON PRACTICE BY SOME MASTER OPERATOR MEL BY BOEING.
